In cases where the original terms of the divorce or family law agreements simply cannot be followed, a new agreement should be negotiated to avoid the penalties of non-compliance. A mediation may assist with finding common ground for settlement when both former spouses are arguing over modifications. When this happens, the former spouses, together with their individual lawyers, will meet with a neutral third-party mediator in order to draft a modification agreement for the court to approve, thus avoiding costly litigation.
